Terms of Service

Effective Date: April 1, 2026

Welcome to Tratok Hospitality. These Terms of Service govern your use of the Tratok Hospitality Service Provider Portal. By registering for and using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

In these Terms, the following definitions apply:

  • "Platform" refers to the Tratok Hospitality Service Provider Portal, including all web pages, tools, and services accessible through it.
  • "Provider" or "You" refers to any individual or entity that registers for an account on the Platform to list and manage hospitality services.
  • "Tratok", "We", or "Us" refers to Tratok and its affiliates that operate the Platform.
  • "Listing" refers to any property, activity, restaurant, or other hospitality service published on the Platform.
  • "Guest" or "Customer" refers to end users who discover and book services through Tratok.

2. Account Registration

To access the Platform, you must create an account by providing accurate and complete information including your full legal name, valid email address, business details, and contact information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must be at least 18 years of age and legally authorised to enter into binding contracts in your jurisdiction. If registering on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.

3. Listings & Content

3.1 Accuracy of Information

You are solely responsible for the accuracy, quality, and legality of all content you publish on the Platform, including property descriptions, photographs, pricing, availability, and any other information associated with your Listings. All information must be truthful and not misleading.

3.2 Content Standards

All content must comply with applicable laws and regulations, must not infringe the intellectual property rights of any third party, must not contain discriminatory, offensive, or harmful material, and must accurately represent the services offered. We reserve the right to review, edit, or remove any Listing that does not meet our standards.

3.3 Photographs & Media

You warrant that you own or have obtained all necessary rights and permissions for any photographs, videos, or other media uploaded to the Platform. Images must accurately represent the current state of the services offered.

4. Bookings & Obligations

When a Guest makes a booking through the Platform for your Listing, you enter into a direct contractual relationship with that Guest. You agree to honour all confirmed bookings at the published price and conditions, provide the services as described in your Listing, communicate promptly and professionally with Guests, comply with all applicable local laws, licensing requirements, health and safety regulations, and resolve disputes with Guests in good faith.

Failure to honour confirmed bookings may result in penalties, including suspension of your account or withholding of payments.

5. Pricing & Payments

5.1 Pricing

You set your own prices for Listings. All prices displayed must include applicable taxes or clearly indicate that taxes are additional. You may update pricing at any time, but changes will not affect previously confirmed bookings.

5.2 Platform Fees

Tratok charges a service commission on each completed booking, the rate of which is communicated to you upon registration and may be updated with prior notice. Fees are deducted from gross revenue before payment disbursement.

5.3 Payment Disbursement

Net revenue from bookings will be made available for payout according to the payment schedule described in your Provider dashboard. Payouts are processed via the payment methods available on the Platform. You are responsible for providing accurate banking or payment details and for any tax obligations arising from your earnings.

6. Intellectual Property

All trademarks, logos, software, designs, and content belonging to Tratok remain our exclusive property. You may not use Tratok branding without prior written permission. By uploading content to the Platform, you grant Tratok a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content in connection with operating and marketing the Platform.

7. Prohibited Conduct

You agree not to use the Platform for any unlawful purpose, provide fraudulent or misleading information, manipulate or circumvent the booking and payment system, engage in discriminatory practices in accepting or denying Guests, access or attempt to access other Providers' accounts, reverse-engineer or interfere with the Platform's operation, or use automated tools to scrape data or interact with the Platform without permission.

8. Suspension & Termination

We may suspend or terminate your account and access to the Platform if you breach these Terms, if your Listings receive persistent negative reviews or complaints, if you fail to honour confirmed bookings, if required by law or regulation, or for any other reason at our reasonable discretion with appropriate notice. You may close your account at any time by contacting our support team. Outstanding payment obligations survive termination.

9. Disclaimers & Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law, Tratok shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of revenue, data, or business opportunities.

Our total aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the total fees paid by you to Tratok in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Tratok, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, your Listings, or your interactions with Guests.

11. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or through a notice on the Platform at least 30 days before they take effect. Your continued use of the Platform after such notice constitutes acceptance of the updated Terms.

12. Governing Law & Disputes

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of the Platform will be resolved through good faith negotiation, followed by binding arbitration or the competent courts, as determined by the applicable jurisdiction.
